1.     Applicability. These terms and conditions apply between you ("Customer") and Potomac Garage Solutions® and any of its nationwide affiliated companies and/or locations, (collectively - “PGS") with respect to your purchases products and accessories ("Products") from http:/www.PotomacGarageSolutions.com (the "Internet Site"). These terms and conditions shall apply and may NOT be altered, supplemented, or amended by the use of any other documents, unless the Customer has signed a separate purchase agreement with PGS, in which case the separate agreement shall govern.
 
2.     Customers. Sales from this Internet Site are limited to Customers who are at least 18 years of age, and who are residents of the contiguous 48 states of the United States and the District of Columbia (not Alaska or Hawaii), and who are purchasing for personal use. PGS will NOT accept orders on this Internet Site from parties who are underage, who are in other territories, or who intend to purchase Products for commercial resale. By submitting an order on this Internet Site, Customer certifies that Customer meets the foregoing requirements.
 
3.    Payment & Orders. Credit card is the only form of payment that will be accepted for Product orders on this Internet Site. All orders received by PGS are subject to acceptance in PGS  sole and absolute discretion. Once accepted, PGS will attempt to fill Customer's order for Products, subject to available inventory. PGS will not be liable for delay in or failure to ship Products.
 
4.    Taxes. PGS is required by law to collect all applicable sales taxes for all states and municipalities. Customer authorizes PGS to charge the applicable sales taxes to Customer's credit card.
 
5.    Shipping & Handling. Shipping/Handling and truck delivery charges are calculated during the checkout process. Products are only available to 48 states of the United States and the District of Columbia.
 
6.    Title; Risk of Loss. Title to Products passes from PGS to Customer on shipment from PGS facility. Loss or damage that occurs during shipping by a carrier selected by PGS is PGS' responsibility. Loss or damage that occurs during shipping by a carrier selected by Customer is Customer's responsibility.
 
7.    Returns & Refunds. Products that are purchased from this Internet Site may be returned by the Customer for a refund in accordance with PGS’ Return Policy in effect on the date PGS accepts the order. For further details on the applicable Return Policy, please call the PGS Customer Satisfaction Center at 1-888 458-COOL. A 25% restocking fee will be assessed and customer will pay all shipping costs.
 
8.    Warranties. PGS' Product warranty obligations are limited to those set forth by the manufacture of the product and  the printed literature included with the Products. For complete warranty details, call the PGS Customer Satisfaction Center at 1-888 458-COOL. PGS DISCLAIMS ALL OTHER WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
 
9.    Limitation of Damages & Liability. PGS shall not be liable to Customer for any special, incidental, consequential or punitive damages, or for any claim by any third party. Customer agrees that for any liability related to the purchase of Products, PGS is not liable for any amount of damages above the aggregate dollar amount paid by Customer for the purchases under this agreement.
 
10.  Reservations & Exceptions. PGS reserves the rights to change prices, terms, specifications and warranties for Products on this Internet Site at any time without prior notice. PGS endeavors to post accurate information, but mistakes can sometimes be made, and any errors in Product specifications, descriptions, and pricing are subject to correction by PGS. PGS reserves sole discretion over the acceptance of orders, and may reject any order that is not consistent with the requirements of these terms & conditions PGS' merchandising policies.
 
11.  Governing Law. This Internet Site is controlled, operated and administered by PGS from its offices in the state of MARYLAND, USA. This agreement and any sales hereunder shall be governed by the laws of the state of MARYLAND, without regard to conflicts of laws rules. Customer agrees to submit to the jurisdiction and venue of the federal or state courts of the state of MARYLAND for any disputes, claims or causes of action involving this Internet Site or this agreement. Customer agrees to abide the laws of the United States and any applicable state laws. No representations are made that this Internet Site or its materials, products or contents are appropriate or available for use outside the United States.
 
12.  Headings. The section headings used herein are for convenience of reference only and do not form a part of these terms and conditions, and no construction or inference shall be derived there from.
